TO THE MAXIMUM EXTENT PERMITTED BY LAW, MITOPHILIX AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST DATA, PROFITS, REVENUE, BUSINESS OPPORTUNITY, OR GOODWILL ARISING FROM OR RELATING TO THE SITE OR THESE TERMS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, MITOPHILIX'S TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED US $100.

13. Indemnification

You agree to defend, indemnify, and hold harmless Mitophilix and its officers, directors, employees, consultants, agents, licensors, and affiliates from claims, liabilities, damages, losses, and expenses arising from your misuse of the Site or breach of these Terms.

14. Modifications and Availability

Mitophilix may update, suspend, restrict, or discontinue the Site or these Terms at any time. Updated Terms will become effective when posted, unless a different effective date is stated.

15. Governing Law and Venue

These Terms are governed by the laws of the State of Michigan, without regard to conflict-of-law rules. Any dispute arising from or relating to the Site or these Terms shall be brought exclusively in the state or federal courts located in Michigan, and each party consents to that jurisdiction and venue.
